Shipping And Handling (Delivery and transport)
We, Pixsell Store, shall make every reasonable effort to meet quoted/ acknowledged delivery dates but shall not be liable in any manner for failure to meet such dates.
The agreed delivery dates and times shall always be approximate and subject to unforeseen circumstances. Time shall not be of the essence for the purpose of delivery.
Failure to meet the delivery date due to Force Majeure, shall not entitle the Buyer to terminate the transaction and/or to demand compensation. Force Majeure shall include, but not be limited to, the following:
- Operational failure or business interruption, irrespective of nature or cause
- Delayed or late delivery by the main supplier and/or manufacturer
- All shipping/delivery delays caused by freight forwarding, logistics services providers – encompassing all carriers and couriers issue.
- Any transportation problem that may hamper or impede the transportation of Products from the manufacturer to the us
- Import and export restrictions of any nature
Furthermore, in no event, we shall have any liability in connection with the transportation or shipment, of the items.
However, if the Buyer fails to take delivery on the designated date, then we shall be entitled to store the items at the Buyer’s expense and risk against a storage fee of 1.5% per month of the invoice value of such items and be entitled to invoice the Buyer for the items and the storage fee.
Having said that, we shall endeavor to execute delivery/transportation with our best efforts, and professional capability that is at par with expert industry standards (such as ours).
